The terms “you” and “your” refer to you, the user of the Site. It operates several booking websites that provide exclusive travel services (the ‘online portal’). These services include a global booking system for hotel reservations and deals, covering both budget and luxury hotels, as well as other travel offerings such as holiday homes. In this document, we refer to these offerings as ACCOMMODATIONS/ACCOMMODATION/HOTEL/HOTELS. All third-party PROVIDERS mentioned will be referred to as SERVICE PROVIDER or PROVIDER.

1.2 The General Terms and Conditions (GTCs) apply to non-binding inquiries made for discount and budget hotel rooms. At the same time, binding bookings are processed for accommodations via the agent’s online portal. Furthermore, the accommodations booked through the agent’s online portal are managed using the online booking systems provided by the agent’s partners, as necessary.

1.3 All such GTCs apply in situations where users intending to book cheap hotels, make hotel reservations, or seek hotel deals do not comply with the other general terms and conditions. These general terms and conditions are not accepted when the agent offers services such as discount and budget hotel rooms or affordable hotel rooms in India, even if users/visitors are aware of the prevailing conditions, unless explicitly agreed to in the situation.

The Site is currently made available to you for your personal, non-commercial use. When you access our site in any way, you are at least 18 years old and have the legal authority to enter into contracts. And use our service lawfully and under these Terms. 2. Services Offered by BookMyHotels

The user or visitor needs to provide their name along with their email address. If the user or visitor is creating an account for business trips and reservations, it is required that they use their name or the name of their employer along with a secure password. When the user or visitor clicks the “Register Now” button, they fully accept the GTCs and agree to the proposal to enter into the contract. We will accept this proposal after receiving confirmation from the user or visitor.

2.2 Planning and the End of Accommodation and Travel Service Contracts

2.2.1. The facilities offered by hotel reservations, discounts, and budget hotel rooms available in the discounted hotel deals also include the planning and the end of accommodation and/or travel service agreements.

To fulfil such purposes, BookMyHotels disseminates the SERVICE PROVIDER's (or the SERVICE PROVIDERs teamed as a result of the signed contract) personal information of the User/Visitor/Customer. 4. Booking and Hotel Reservations

9.5 – Our Service Fee – We charge a non-refundable service fee for each transaction completed via the Site. Our service fee is separated from the rate of the room(s). OUR SERVICE FEE IS NON-REFUNDABLE, EVEN IF YOU MODIFY AND/OR CANCEL A MODIFIABLE/CANCELLABLE BOOKING. The total price will include our service fee.

9.6 - BookMyHotels is not legally bound to complete the process of hotel reservations, and we are also not responsible in any way for causing errors or faults concerning the hotel room services engendered by the respective SERVICE PROVIDER. Here, the agent is not going to make any assurances of any kind for completing the suggestions or requests forwarded by the customer.

9.7 – The legal liabilities of agents are not included, irrespective of the fact that the damages are caused therein, if and only if the damages are caused as a result of:

  • Breach of duties that are culpable and can duly affect the performance of clauses written in the agreement, and where compliance is considered essential for the contractual partner to rely on it.

9.8 – The entire warranty claims and the claims made against the compensation are limited by the means of the Statute of Limitations, with the time limit not exceeding 1 Year after the customer has become aware damages caused. However, such claims do not result from errors caused out of tort.

10. Pricing

10.1 - The rates displayed on the Site are a combination of the rates and fees charged by the SERVICE PROVIDER supplying your accommodations, such as the hotel or hotel supplier. These rates and also, these Terms and Conditions are applicable only if you are an Indian resident or you are located in India. If you are not, please select your country at the bottom of the page.

10.2 - Our Service Fee – We charge a non-refundable service fee for each transaction completed via the Site. Our service fee is separated from the rate of the room(s). OUR SERVICE FEE IS NON-REFUNDABLE, EVEN IF YOU MODIFY AND/OR CANCEL A MODIFIABLE/CANCELLABLE BOOKING. The total price will include our service fee.

10.3 - Accommodation Provider Fees and Charges – There are other charges that the Accommodation Provider may charge you, such as a resort fee, that are not included in the amounts we collect from you. You will have to pay those charges directly to the Accommodation Provider. Before booking, you should check with the Accommodation Provider to determine whether they charge additional fees upon your arrival.

10.4 - Taxes and Booking Partner Fees - In addition to the rate and our service fee, our Site displays a line item for “Taxes and Fees,” which you will be charged when making your reservation. “Taxes and Fees” consists of: (i) an estimate of the taxes payable by the hotel in connection with your booking, including, but not limited to, sales and use tax, occupancy tax, room tax, excise tax, value added tax and/or other similar taxes; and (ii) if applicable, taxes payable by our Booking Partner in connection with your booking; and (iii) service fees retained by our Booking Partner and our service fee.

10.5 - We do not collect taxes for remittance to applicable taxing authorities. The hotel is responsible for remitting applicable taxes. In certain jurisdictions, our Booking Partner may also be responsible for remitting taxes related to your booking. Neither we nor any of our Booking Partners act as a co-vendor with each other or with any hotel.

10.6 - Taxability and the applicable tax rate vary based on several factors, including, but not limited to, the location of the hotel and the room rate paid to the hotel by our SERVICE PROVIDER. The amount paid to the hotel for taxes in connection with your booking may vary from the estimated amount charged to you, depending on the rates, taxability, and any other metric in effect at the time of your actual stay. If the amount paid to the hotel is less than the estimate, the balance of the charge for “Taxes and Fees” is retained by us and/or our SERVICE PROVIDER as part of our and/or their compensation for facilitating and servicing your booking.

“Taxes and Fees” does not include other charges, like hotel resort fees, hotel energy surcharges, parking fees, pet fees, and incidental charges (such as room service, mini-bar, gratuities). Unless otherwise indicated, these amounts will be collected from you directly by the hotel.

THE FINAL TOTAL PRICE DISPLAYED AT CHECK-OUT OR QUOTED BY AN AGENT IS THE AMOUNT YOU WILL BE CHARGED, SO PLEASE REVIEW THE FINAL TOTAL PRICE CAREFULLY.

While we thoroughly review the pricing information on the website, changes do occur, and errors are occasionally made. WE RESERVE THE RIGHT TO CORRECT ANY PRICING ERRORS ON THE SITE, FOR PENDING RESERVATIONS, AND FOR ANY NON-REFUNDABLE BOOKINGS. IF YOUR PENDING RESERVATION CONTAINS A PRICING ERROR, YOU WILL BE NOTIFIED AND PROVIDED THE CHOICE TO EITHER ACCEPT THE CORRECTED PRICE OR CANCEL WITHOUT PENALTY.

BookMyHotels quotes prices in INR currency, based on the exchange rates for the respective foreign currency. Exchange rates are subject to fluctuation. Your exchange rate is only fixed when full payment is made. Additionally, your payment provider (e.g., your credit card company) may charge conversion fees and apply another date’s currency rate.

Some Accommodation Suppliers may require you to present a credit card or cash deposit upon check-in to cover additional expenses incurred during your stay. Such a deposit is unrelated to any payment received by BookMyHotels for your booking.

11. Force Majeure

BookMyHotels shall not be liable at any time, in any way, for loss, injury or damage arising from an act of nature, any force majeure, acts of government or de facto authority, government-imposed prohibitions, war, threat of war, civil unrest, any kind of hostilities, terrorist activities, industrial disputes, strikes, theft, robbery, sickness, health risks, pandemic, epidemic, accident, quarantine, immigration or customs regulations, hijacking, closure or congestion of airports or ports, breakdown, delay, cancellation, error, omission, inclement weather, storms, tempests, hurricanes, volcanic eruptions, delay or default of any person engaged in providing any accommodation, hotel closures, or any other cause beyond its control. In such cases, BookMyHotels will not be responsible for any refund. Any refund you may be entitled to will be from the Accommodation Provider. The Accommodation Provider may choose to offer credits instead of a refund. We are not responsible for an Accommodation Provider’s failure to pay a refund or for supplier bankruptcy or insolvency, etc.

12. Insurance

BookMyHotels strongly recommends that you purchase a Travel Protection Plan, which includes additional Cancel for Any Reason coverage. Such a plan at a minimum should cover Trip Cancellation or Interruption, Cancel for Any Reason, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel insurance plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason, such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections, and baggage loss. Purchasing coverage may be limited by time constraints, so you must purchase protection as soon as possible after booking.

If you choose to travel without adequate coverage, we will not be liable for any of your losses, however arising, for which travel insurance plan coverage would otherwise have been available.

13. Destination and Travel Requirements

Travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism, and warfare. BookMyHotels is not in a position to advise or recommend whether travel to any particular place at any particular time should take place, and the display or availability to book accommodations in a destination is not a representation or warranty by BookMyHotels that travel to the destination is without risk. 15. Refund

Refunds will be processed as per the terms provided by the SERVICE PROVIDER at the time of booking and as per the cancellation policy. Such refunds shall be subject to BookMyHotels receiving the same from the SERVICE PROVIDER. However, the service fee paid to BookMyHotels at the time of booking is non-refundable.

If the refund is applicable will be credited to the same account from which the payment was made. For example, if the User used a credit card, BookMyHotels will make an appropriate charge reversal to the same credit card; likewise, if the User used a debit card, BookMyHotels will credit the money to the same debit card.

16. General

Nothing contained in these Terms will be deemed to constitute either party as the agent or representative of the other party, or both parties as joint venturers or partners for any purpose. You may not assign, delegate, or transfer your rights or obligations under these Terms.

BookMyHotels may assign our rights and duties under these Terms without such assignment being considered a change to the Terms and without notice to you, provided your rights under these Terms are not prejudiced.

This Agreement is subject to interpretation as per the laws of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Delhi.
